Scribbos Acceptable Use
Policy ("AUP")
I. Introduction
This Acceptable Use Policy (“AUP”) governs the use by the You of the Services and, more specifically, of the User Files and data contained therein that are sent or received by You utilizing the Services. Capitalized terms used, but not otherwise defined, herein shall have the meanings set forth in the ScribbosSM SaaS Services Agreement and into which this AUP is incorporated by reference.

II. Compliance with Law
You shall ensure that all use of the Services and User Files by You, and each User Related to You, and any and all communications to third parties made in connection with such use, whether by or through You or any User Related to You, are in compliance with all applicable federal, state, local and foreign laws, rules and regulations, including, without limitation, laws, rules and regulations relating to privacy, consumer credit and debt collection (including, without limitation, The Fair Credit Reporting Act), The Gramm-Leach-Bliley Act (15 U.S.C. Sec. 6801 et seq. and its implementing regulations, including, without limitation, 16 C.F.R. Part 313.1 et seq.), and the Health Insurance Portability and Accountability Act (45 C.F.R. Part 160.101 et seq.).
In addition, with respect to the User Files, You hereby represent and warrant that (i) You have the lawful right to copy, transmit, distribute, upload and display all such User Files; (ii) to the extent applicable, You have the consent and permission of each identifiable person in the User Files to use the name, voice, signature, photograph and/or likeness of such person; (iii) no transmittal, transfer and/or use of the User Files in accordance with this Agreement will infringe upon or misappropriate the intellectual property or proprietary rights, or violate the privacy, moral, or publicity rights, of any third party; (iv) no use or transmittal of the User Files will be false or misleading, defamatory, obscene, pornographic or offensive; (v) no use or transmittal of the User Files will promote bigotry, racism, hatred or harm against any individual or group; and (vi) no use or transmittal of any User Files will violate, or encourage any conduct that would violate, any applicable law, rule or regulation or will give rise to civil liability.
III. Prohibited Uses of the Services
In addition to the other requirements of this AUP, You may only use the Services and the User Files in a manner that, in Scribbos’ sole judgment, is consistent with the purposes of the Services. If You are unsure as to whether any contemplated use of the Services or action related thereto is permitted, please contact Scribbos as provided above prior to using the Services in such manner or to taking such action (as applicable). By way of example, and not limitation, the uses described below of the Services are expressly prohibited.
3.1. General.
3.1.1. Use of the Services to transmit, route, provide connections to, or store any material that infringes any copyrights or otherwise violates, or promotes the violation of, the intellectual property or proprietary rights of any third party;
3.1.2. Use of the Services in any time-sharing, service bureau or other resale arrangement without the prior written consent of Scribbos in each instance, including, without limitation, any use to provide services, transmit, transfer or process data for the benefit of, or on behalf of, any third party, except for other Users;
3.1.3. Deceptive on-line marketing practices;
3.1.4. Actions that restrict or inhibit any third party, whether another User, a customer of Scribbos, a third-party host or otherwise, in its use, enjoyment or support (as applicable) of the Services;
3.1.5. Impersonating or misrepresenting Your affiliation with Scribbos or with any third-party; and
3.1.6. Using the trademarks, trade names or logos of Scribbos or of any third-party licensor of Scribbos for any purpose whatsoever without the prior written consent of Scribbos in each instance.
3.2. System and Network.
3.2.1. Use of use any automated messaging or other tools, including, without limitation, those that result in spamming, unsolicited email, junk mail, chain letters, or promotions or advertisements for products or services, in connection with the Services, the User Files and/or any communications to
other Users in relation to either of the foregoing;
3.2.2. Introduction of malicious programs into the Scribbos network or the Scribbos servers (e.g., viruses or worms);
3.2.3. Effecting security breaches or disruptions of Internet communications. Security breaches include, without limitation, accessing User Files and/or data of which You are not an intended recipient or logging into a server or account that You are not expressly authorized to access by means of hacking, obtaining a password without proper authorization or otherwise; and
3.2.4. Circumventing User authentication or the security of any host, network or account.
3.3. Billing.
3.3.1. Furnishing false or incorrect data on the User Information Screen or any online application or form related to the Services, including without limitation, fraudulent use of credit card numbers; and
3.3.2. Attempting to circumvent or alter the processes or procedures used by Scribbos to measure Your storage of data in connection with the Services or to disrupt Scribbos’ ability to determine whether such storage exceeds the Storage Volume Limitation.
3.4. Mail.
3.4.1. Sending unsolicited mail messages, including without limitation, the sending of "junk mail" or other advertising material to individuals who did not specifically request such material (e.g., "e-mail spam") (see also, Section 3.2.1, hereof);
3.4.2. Harassment, whether through language, frequency or size of messages; and
3.4.3. Creating or forwarding "chain letters" or other "pyramid schemes" of any type. |
